These Terms apply to all visitors, users, and others who access or use our restoration services, including but not limited to water damage restoration, fire restoration, mold remediation, leak detection, and emergency services.

Lifeline Restoration provides emergency restoration services including:

  • Water damage restoration and extraction
  • Fire and smoke damage restoration
  • Mold inspection and remediation
  • Leak detection and repair coordination
  • Pack-out and storage services
  • 24/7 emergency response services
  • Insurance claims assistance

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We may also impose limits on certain features or restrict access to parts or all of the services without notice or liability.

3. User Responsibilities

When using our Site and services, you agree to:

  • Provide accurate, current, and complete information when requesting services
  • Maintain the security of your account credentials (if applicable)
  • Notify us immediately of any unauthorized use of your account
  • Comply with all applicable federal, state, and local laws and regulations
  • Not interfere with or disrupt the Site or servers or networks connected to the Site
  • Not use the Site for any unlawful or prohibited purpose
  • Not attempt to gain unauthorized access to any portion of the Site
  • Provide safe and reasonable access to your property for our technicians to perform restoration services
  • Disclose all known hazards, including but not limited to asbestos, lead paint, or structural damage

You are responsible for ensuring that your property is accessible and safe for our technicians to work. Failure to disclose known hazards may result in additional charges or termination of services.

4. Intellectual Property Rights

All content on this Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Lifeline Restoration or its content suppliers and is protected by United States and international copyright laws.

The compilation of all content on this Site is the exclusive property of Lifeline Restoration and is protected by U.S. and international copyright laws. All trademarks, service marks, and trade names are proprietary to Lifeline Restoration or other respective owners.

You may not:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without express written permission
  • Use any automated system or software to extract data from this Site for commercial purposes ("screen scraping")
  • Modify, adapt, or create derivative works from any content on the Site
  • Remove or alter any copyright, trademark, or other proprietary notices

5. Service Agreements and Estimates

All service estimates provided are approximations based on initial assessments and are subject to change upon further inspection. Final costs may vary depending on the extent of damage discovered during the restoration process.

By authorizing services, you agree to:

  • Pay for all services rendered in accordance with our pricing and payment terms
  • Allow us to work directly with your insurance company (if applicable)
  • Be responsible for any amounts not covered by insurance, including deductibles
  • Provide timely decisions regarding the scope of work to avoid project delays

Emergency services may be initiated without a signed agreement to prevent further damage. By allowing our technicians to begin work, you agree to be responsible for payment of services rendered.

6. Payment Terms

Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, check, credit cards, and insurance assignments.

For insurance claims:

  • You are responsible for your insurance deductible
  • You are responsible for any amounts your insurance company does not cover
  • We will work directly with your insurance company, but you remain ultimately responsible for payment
  • Any disputes with your insurance company do not relieve you of your obligation to pay for services rendered

Late payments may be subject to interest charges of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less. You agree to pay all costs of collection, including reasonable attorney fees, if your account is referred for collection.

7. Cancellation and Refund Policy

You may cancel scheduled services by providing at least 24 hours' notice. Cancellations with less than 24 hours' notice may be subject to a cancellation fee.

For emergency services already initiated, you may stop work at any time, but you will be responsible for payment of all services rendered up to that point, including mobilization costs, labor, materials, and equipment rental.

8. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LIFELINE RESTORATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use our services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our Site
  • Any bugs, viruses, or the like that may be transmitted to or through our Site by any third party
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site
  • Pre-existing conditions, hidden damage, or damage not discoverable during initial inspection
  • Delays caused by insurance companies, third parties, or circumstances beyond our control

IN NO EVENT SHALL LIFELINE RESTORATION'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SITE OR SERVICES, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Warranties and Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner in accordance with industry standards. However, restoration work involves many variables beyond our control, including pre-existing conditions, hidden damage, and the age and condition of materials.

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content obtained through the Site.

10. Indemnification

You agree to defend, indemnify, and hold harmless Lifeline Restoration, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with: (a) your access to or use of the Site or services; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; or (d) any claim that your use of the Site or services caused damage to a third party.

11. Insurance and Licensing

Lifeline Restoration is fully licensed and insured to perform restoration services in the State of Nevada. We maintain general liability insurance and workers' compensation insurance as required by law. Proof of insurance is available upon request.

12. Ambassador Program Terms

Our Ambassador Program allows participants to refer customers and earn commissions on completed projects. By participating in the Ambassador Program, you agree to:

  • Provide accurate referral information
  • Not misrepresent Lifeline Restoration or make unauthorized promises on our behalf
  • Comply with all applicable laws, including tax reporting requirements
  • Submit W-9 tax information before receiving cumulative payments exceeding $500
  • Understand that commissions are paid only on completed and paid projects

We reserve the right to terminate Ambassador Program participation at any time for violation of program terms or these Terms of Service.

13. Privacy and Data Protection

Your use of the Site and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

14. Third-Party Links and Services

Our Site may contain links to third-party websites or services that are not owned or controlled by Lifeline Restoration. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Lifeline Restoration shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

15. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Las Vegas, Nevada, before one arbitrator.

The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

YOU UNDERSTAND AND AGREE THAT BY ENTERING INTO THESE TERMS, YOU ARE WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Clark County, Nevada for the purpose of litigating all such claims or disputes.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law. The failure of Lifeline Restoration to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

18. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site and services after revisions become effective, you agree to be bound by the revised terms.

19. Entire Agreement

These Terms, together with our Privacy Policy and any service agreements you sign, constitute the entire agreement between you and Lifeline Restoration regarding the use of our Site and services, superseding any prior agreements between you and Lifeline Restoration relating to your use of the Site or services.
